Chelmsford and Essex

Terms and Conditions

Rooflight specialists only 10-year workmanship guarantee Fixed written quotes 30 miles of Chelmsford

These terms apply to rooflight and roof window installation work carried out by Sunspire Skylights Chelmsford for private customers in England. They sit alongside your statutory rights, which come from the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Nothing here reduces those rights, and where a term conflicts with them, the law wins.

Who you are contracting with

The contracting party is Sunspire Skylights Chelmsford, a rooflight installation business working across Chelmsford and roughly thirty miles of Essex by road. Trading status and any company registration number are [to be confirmed]. Correspondence about a quote, a booking or a completed job goes to info@sunspireskylightschelmsford.co.uk.

How a contract comes into existence

Nothing is binding until three things have happened in order. First, a survey of the actual roof. Second, a fixed written quotation issued after it, itemising the unit, the structural work, the covering work, access and the Building Control notification. Third, your acceptance of that quotation in writing.

An indicative range given by email before a survey is a guide to whether the project is in the right territory. It is not an offer capable of acceptance. How the two figures are arrived at is set out on the pricing page.

The quotation also states its assumptions, since they are the honest basis of the figure: the pitch measured on the day, the covering identified, the structure as seen, and access as it stood at survey.

Variations found once the covering is off

Some things stay hidden until the covering comes off: a trussed rafter where a cut roof was assumed, a rotten wall plate, or a deck that has taken water. Where that happens, work stops and you get the position in writing: what has been found, what it changes, what it costs and what it does to the programme. Nothing extra is carried out until the variation is agreed. The roof is made weathertight at the end of each working day regardless of where a discussion has got to.

Your right to cancel under the Consumer Contracts Regulations 2013

Where a contract is agreed away from business premises or at a distance, which covers a quotation accepted by email or agreed at your home, you have fourteen days from the day it is made to cancel without giving a reason.

Two points are worth knowing. If you ask in writing for work or ordering to begin inside that window and then cancel, you can be charged for what has genuinely been done. And the Regulations exclude goods made to your specification, which here means a unit in a non-standard size or a special glazing build-up. Stock-size units are unaffected. To cancel, email the address above.

Payment

Payment stages, amounts and method are set out on the written quotation and agreed before work is booked. Any deposit or staged payment terms are [to be confirmed]. An agreed variation is invoiced with the stage it belongs to, as a separate line rather than folded into an existing total.

Access, scaffold and site conditions

You are asked to provide reasonable access to the roof and the room below on the agreed dates, and to clear the working area. Protection goes down over what remains. Scaffold or a tower, where needed, is identified at survey and priced in the quotation. Where access depends on a neighbour’s land, obtaining that permission is your side of the arrangement, and the commonest cause of a delayed start.

Building Regulations and the notification

Installing a new rooflight or replacing an existing one is notifiable work under the Building Regulations in England, engaging Part L for thermal performance, Part K where there is a risk of falling and Part B where the opening is a means of escape. Sunspire arranges the notification as part of the job unless the quotation states that a main contractor is handling it.

Where the property is listed, or sits in a conservation area with permitted development rights removed by an Article 4 direction, consent is a separate matter whose timing is outside either party’s control.

Materials, units and manufacturers’ warranties

Units supplied are those named on the quotation. Where a manufacturer discontinues a model or size between quotation and order, you are told before anything is ordered and offered the nearest equivalent at the same specification, with any price difference either way.

Each unit carries its own manufacturer’s warranty, handed over at completion. The workmanship carries a separate ten-year guarantee.

Your rights under the Consumer Rights Act 2015

The Act gives you rights that stand whatever a contract says. Services must be carried out with reasonable care and skill, within a reasonable time where none was fixed. Goods supplied with the service must be of satisfactory quality, fit for purpose and as described. Where a service falls short, the statutory remedies are repeat performance, or a price reduction where that is impossible or cannot be done in reasonable time. They apply in addition to the ten-year workmanship guarantee, not instead of it.

Liability

Sunspire is liable for loss or damage you suffer that is a foreseeable result of a breach of these terms or a failure to use reasonable care and skill. Liability is not limited or excluded for death or personal injury caused by negligence, for fraud, or where the law prohibits limitation. Insurance cover and its limits are [to be confirmed]. Ask for the current certificate before accepting a quotation.

Data, complaints and governing law

Information you supply during an enquiry, a survey or a job is handled as described in the privacy policy. If something is wrong, the complaints procedure sets out the steps and their order.

These terms are governed by the law of England and Wales, whose courts have jurisdiction. They may be updated for future contracts, and the version applying to your job is the one in force on the date your quotation was accepted. Current version date: [to be confirmed].
